Family Center - Tell it to Tillie

Q In March of this year, I was terminated from a company for violating company policy. What I did was this: I was spotted leaving a barroom (during a two-day layover) and then entering my truck. This is against the company's policy. My question is, where can I find work as a driver with this on my record at this company? Companies ask me why I was terminated and when I tell them the truth, they disqualify me. P.S., this incident did not wind up on my DAC report! Thanks.

A

You're lucky you don't have a DUI on your record. Just being in a vehicle and intoxicated with control of the keys (even if they are in your pocket) is a DUI in most states now.

I don't endorse lying but there is such a thing as giving too much information. A simple "violation of company policy” should be sufficient. If more information is requested, find a way to tell the truth that doesn't reflect too badly on you. "Another driver saw something, took it out of context, and I was let go.”

Next time you decide to have a drink on a layover, rent a hotel room. It may save you from far worse consequences than loosing a job.

Q I had accident in May while driving. I was not at fault but I had damage to my heart. The doctor told me he wants to put in a pace maker. He said if I do I have give up my CDL. I've been out here for 30 years don't know anything else. Who do I contact to find if it's the truth? I feel fine.

Feeling fine doesn't mean everything is all right. Heart problems can be silent killers. First, get a second opinion. It may be that this doctor is over zealous but don't ignore him just because you "feel fine.” A second opinion should clarify your condition and options.

The bad news: a pace maker may very well disqualify you. Heck your heart condition may disqualify you. The FMCSR on Physical disqualifications can be found at  ( FMCSR 391.41). Read through it and talk to your local motor vehicle department about how this may affect you. I really can't see getting a pace maker stopping you from driving. I would be more apt to believe not getting the condition treated and under control to be more of a reason for disqualification.

Do not ignore your health. It maybe that your body is telling you it's time for a change of careers and to slow down. Listen!
