Default NON PAYMENT OF CHILD SUPPORT

I was wondering if someone could answer a question for me
about non-payment of child support and CDL licenses. I
heard a CDL could be revoked until pays support payments
were caught up on. My deadbeat ex who is a so called
trucker abandoned me and his 2 small children 2 years
ago(when he became a long haul trucker) is now behind
15,000.+ in child support. He is living high off of the
hog right now and does nothing to hide this fact from me.
He tells me he cant afford to pay for the kids because he
has started a new life now for himself and has to live to
you know. He has to save his money to become an owner
operator. Since he as left our house was forclosed upon
since he wasnt staying there why should he have to pay for
it our car went as well...he's not driving it you know...
Little does he realize that his name was on them as well
and the chances of anyone financing him for even a pencil
is slim to none.
Can anyone point me in the right directon to go with this
one. He is what is known as a gypsy driver...he goes from
company to company. He will quit his job if he doesnt get
that pretty new truck or the load wants. I cant sign my
name to this because I dont know if he knows of this site
or not and I dont want to spook him to quiting this job and
work under the table somewhere.
Belive me I would love to tell you HIS name because I know
there are "real men" out there that love, appreciate and
support there families who whould love to take a few shots
at this deadbeat in the back of a truck stop parking lot
somewhere. All you would have to do is just look at those 2
little face that did nothing to deserve this.
I dont want to ruin him I just want my kids to get what
they deserve. He helped bring him into this world and he
should be helping support them. His kids didnt do anything
to him except give him unconditional love. He cant even be
bother calling them or sending them anything to show them
that daddy still loves them or remembers them for that
matter...but you can bet daddy's not suffering right now
like they are.
Thanks for all of our help

What is your point of posting here?

Contact the state you live in and get his CDL revoked....now how the hell do you expect him to pay you? I'm sure you can support your 2 kids on your own. I know a woman that raised 4 with no outside support.

Just do what's got to be done.

It sounds like you are in contact with your ex-husband
from time to time. Do you know where he is when he talks
to you, and could you give this information to the attorney
general in your state, and maybe get them to force him
to pay? Dan is right about one thing, you may have waited
too long. Now it will be difficult for people to sympathize
because you have been making it somehow. I recently
went online with a problem I am having, and I am sure a
lot of the truckdrivers who read my post probably thought
the same thing about me. I guess we think things will
take care of themselves somehow, or change, so we wait.
If he has denied his feelings for your children, then he
will probably never willingly support them. This happened
to someone very close to me. She lived in a small room
at the back of our house, she had back troubles and could
not take care of the baby. I had to leave work to fix
formula and bathed the baby every night, made formula too
for 6 mos. After she got past being mad and feeling hurt
and abandoned, she got on food stamps, and housing, and
started to make a life for herself and her son. She
got a job, and eventually bought a mobile home and a nice
car. She takes very good care of herself and him, and
her deadbeat husband, (not only goes from job to job,
but from woman to woman) has less than her!!
I am not criticizing you for wanting him to help, believe
me, I am just saying, it may never happen. Trucker
husbands and exes have a unique advantage over us. They
can call us, at least knowing what town we are in, but
we can't just pick up the phone and call them, unless they
have a cell phone. they are very hard to reach, esp.
when you have to go through dispatchers just to get a
message to them. Any most companies will not tell you
where they are. But, like you said, there are some very
good men and women drivers out there.
Maybe someday he will change and become responsible and
want to help you. I hope this happens, but if not, it
sounds as if you can take care of them financially. It
is harder to deal with the fact that their father does not
want them, which I am assuming is the case.
I hope you get this problem worked out.

Hello..just had to add my 2 cents if its worth that at all. Something to think about, if you know the company that hes currently with, get a hold of attorney and see if child support can be automatically deducted. If its been 2 years, I know its hard but u need to look forward and just face the fact that you might not ever see a red penny from that man.
Also, I know you said its been 2 years, and I would like to suggest that if you havent had closure to that relationship (i.e. Divorce), you need to do so in order to move on.
Take care and good luck

Thank you Beadspread... this is the reply I was hoping for. I appreciate the site info you sent...that was what I needed. I dont want to ruin him(although he would deseve it for what he had done) I just want my kids to get what they deserve. They deserve his love but if that is too difficult to give then send the checks. I never pushed or demanded money from him... even at our lowest... on the verge of loosing everything. But now its time to grow up and pay. My kid deserve it.
Of course a nerve was struck...there are more deadbeats out there than we seem to relize. They dont seem to like the term Deabeat though for some reason...maybe the term SCUMBAGS or CHILD ABUSERS would be more fitting. Thats what they are doing in my opinion is dening and playing game with the minds of there own flesh and blood.(now I have really opened a can of worms with that one) Making them think they are to blame for the daddy going and not sending money cause he doesnt love them(as much as himself obviously)anymore.
BTW...the 2 job thing is over with now...I worded that wrong...at the beginning of this ordeal I was working 2 jobs...the daycare nightmare is still there though and will be for quite a few years still. Your right...Nothing is worse than the guilt of leaving a confused crying baby in the care of a stranger when they are used to being home with mom.

Default Re: NON PAYMENT OF CHILD SUPPORT

Why bite off your nose to spite his face?...

Yes, you can get his CDL revoked for non-payment of
support but then he can't make a living for anyone
(including your kids) unless he goes to work at a
McDonald's somewhere.
And you won't get much money out of that.

It is just as well to get his wages garnished
from his current employer. It doesn't cost more
than a simple filing fee but the paperwork and
records you must produce are horrendous.

Whichever you choose, go see your county clerk and
they will refer you to the appropriate agency in
your area to file a complaint.
Usually there are child support offices within the
county courthouse for your jurisdiction.
Be prepared to bring any check stubs from your work,
paternity papers, birth certificates, and an itemized
list of your income and living expenses to get the
ball rolling.

Also, your ex must be legally served with a court order
(by a process server, sheriff, clerk, etc.) to make the
decree legal and binding against him.
This may be difficult if he is on the road much of the time.
Needless to say, this may take some time so I suggest you
waste none in getting started.

All the best,
G.

I'm glad to see that you are getting a lot of good advice
now, not criticism. You don't need that. You are not the
one at fault. Don't worry about his license, you will not
be responsible for losing him his job, HE WILL. What he has
done to you and your children is much worse.
One other thing, if you are divorced and have established
child support payments, if he is not paying, not only
will they take it out of his wages, he will also lose his
income tax refund if he is behind on payments. The person
I told you about gets her ex's return every year. Yes,
she picked herself up and did great, but the emotional
effect it had on her was devastating, and she worried about
her child's feelings, as you do. She never relented. Her
ex was also made to provide health insurance for their son.
You don't have to fight this on your own, but first you
need to get him to court. Believe me, it can be done.
This guy drove a truck for a while too, and skipped from
one place to another, but they still found him.
I hope you will be able to get the help you deserve.

Default Road Trash?

>>Sounds like you married a real hero...and from some of the comments you have received here...have struck the nerve of some other real heroes...I believe the term is "Road Trash."<<

Let me see....the guy wants nothing to do with his kids. So rather than let it go at that, someone sooo concerned about their children's lives is going to force further contact. This way the kids can be constantly reminded of how their own father doesn't give a **** about them. That'll be WONDERFUL for their self-esteem!

With the tone of most of your posts BEDSPREAD you are the last person that should be throwing around the term "Road Trash".
